It is now a specific requirement under the Act that a retail lease for a term of three years or more (including any option period) must be registered by the Landlord within three months after the Tenant’s signed lease is returned to the Landlord.


The Retail Leases Act governs the relationship between landlords and tenants of retail shops in NSW. Businesses which are subject to the act are listed in Schedule 1. New legislation has been introduced into the New South Wales Parliament that, if passe will make significant amendments to a number of the provisions of the existing legislation governing retail shop leases in New South Wales.
