Pre settlement inspection with tenants

Ideally you would do the inspection after the vendor (or tenant ) has vacated the property. However, this is not always possible given that often the vendor (or tenant ) doesn’t move out of the property until the settlement date. However, Buyers are still entitled to a pre-settlement inspection if their new property has been bought at auction.


Known as the pre-settlement inspection , this step is a crucial one – especially if someone has been living in your new home since you signed the contract of sale , as this makes it more likely that the home won’t be in the same condition as when you bought it, which it’s required to be. One of the last boxes to tick before settlement day is the pre-settlement inspection. You’ll all be familiar with the concept and no doubt have had some interesting experiences.


When the appliances have been installe the windows cleaned and the final lick of paint has drie it’s time to visit your brand-new apartment for what’s known as a pre-settlement inspection. Most off-the-plan contracts include a clause allowing the buyer a walk-through of the property on completion before final settlement. The date really depends on the vendor and their circumstances. It may feel like you’re finally at the finish line and NOTHING is going to stand in your way of settlement. The final inspection hurdle is one that you must jump. These obligations can arise from special conditions contained in the contract. Usually on settlement , your solicitor would send an authority to the agent releasing the deposit to them.

The main aim of a pre - settlement inspection is to make sure that the house is ready for takeover and immediate occupation, whether by yourself or tenants. So what are you waiting for? Pre - settlement inspections are conducte as the name suggests, just before settlement.


These inspections are held for the benefit of the purchaser. Under a contract of sale, purchasers have the right to ensure the property purchased is in the same condition it was in when they first signed the contract of sale. Ideally, we suggest to our clients they do their inspection after the vendor or tenant has left the property. However, we appreciate this isn’t always possible given vendors and tenants often don’t move out until the settlement date. A pre - settlement inspection is done about a week before settlement.


Its aim is to make sure any special conditions have been met, and that the property is in the same state as when the contract was signed. You can do the pre - settlement inspection with the agent or the seller. If the vendors or their tenants are living in the house till the settlement date, then it makes sense to inspect the house after they have left (but before the settlement ). This way you will see if anything is missing, broken or if anything unwanted has been left behind. You are entitled to make it a stipulation in the contract of sale that you will carry out a pre - settlement inspection. This can be done at any reasonable time one week before settlement.


And if you’re taking on a property that was tenanted we’d recommend you do your pre - settlement inspection after the tenants have moved out and before their bond has been refunded with the property manager so that you can discuss any issues with the property manager prior to their bond being returned (of course comparing to their incoming condition report). What a purchaser can do depends on the situation. The pre - settlement inspection is an essential step in the home buying process. If the property is being sold with a tenancy that will continue when the buyer takes over the property, the buyer may not be entitled to a pre - settlement inspection. Tenants must allow the landlord reasonable access for inspection and the carrying out of works in accordance with the tenancy agreement. The landlord should give reasonable notice of the need for. Give The Tenant Time To Prepare The letter to tenant for inspection should be sent enough in advance to give the tenant time to prepare.


It may be polite for the property owner to do the inspection on a weeken so the tenant need not take time off work to be present.
