Depending on when you issue your notice , you may or may not need to pay more rent.

For instance, you could pay your rent on the same day you issue your 30-day notice. This only works if your rent. It depends on your lease. If it expired you can give your own day notice and only pay rent for that days.


If you are under a lease that will not have expired after the one month you live there then yes, you owe rent for both months. It should state on your lease. Without it being stated most states require days, for both you and the landlord.

In other words, a month-to-month verbal lease would require the landlord to provide days ' written notice to the tenant for changes such as rent increases and notices to vacate. If you want to move out early, notify the landlord in good time so that a check out report can be arranged before you go, but make it clear to the landlord that you accept that you are liable to pay rent until the end of your notice period. Or until the end of the fixed term if you are moving out before your fixed term has ended. If you are sending this - day notice because of a breach of contract, you would want to add another sentence or two here detailing what clause of the lease contract was broken and what the tenant can do to amend that breach.


If it says nothing about giving notice from rental date, then you can give notice anytime, and your rent should be adjusted for the last few days. Example: you give days notice on Feb 15th so you need to be out by Mar 15th, so technically you owe him half of March. Our tenant has give notice and said they want to leave asap as they have seen something else they want to move into. They are on a periodic monthly lease and they pay monthly at the beginning of the month.


Month to Month Agreements: For month to month agreements, it is generally accepted for the tenant to notify the landlord at least days in advance of their desire to move. Talk with the landlord. Once, I have told my landlord that I was leaving Jan 15th which was many years ago and she accepted it and allowed me to pay only half of the rent. So like I sai depends on your landlord. While I cannot give you legal advice in this forum, as a general matter you have to pay the entire month.


However, remember, if he demands you pay the full month, then you do not have to give him the keys until the last day and he cannot re- rent until after the days expires.
