Overpayment regulations

This paragraph applies where an overpayment occurred due. PART Amendment of provisions relating to recovery of overpaid housing benefit. In calculating the amounts recoverable under section (1) of the Act or regulation 1 where there has been an overpayment of benefit, the adjudicating authority shall deduct— (a) any amount.

In some cases, you might have to pay a civil penalty if you do something which causes an overpayment. You can appeal against a decision to impose a civil penalty. However, recouping an overpayment in this way is often not reasonable. Where an employer has made an accidental overpayment of wages, the statutory position is that the employer can recover this by deducting the overpayment from future wages or salary.

This is because there is an exception to the rule on unlawful deductions to allow for the recovery of overpayments. The normal limitation period under the Limitation Act is six years - for things relating to land or covered by a deed.
